These Terms of Use ("Terms") govern your access to and use of the website located at https://www.makinggood.studio/ ("Site"), operated by The Making Good Studio, LLC ("TMGS," "we," "us," or "our"). By visiting or using the Site, you agree to these Terms. If you don't agree, please don't use the Site.
These Terms cover your use of the website only. They do not govern any consulting, strategy, operations, or production services TMGS may provide - those are governed by a separate Service Agreement, Statement of Work, or invoice terms agreed to directly with you.

2. The Site Is Informational
Content on the Site - including service descriptions, case studies, blog or article content, and any AI-related commentary - is provided for general informational purposes only. Nothing on the Site creates an obligation for TMGS to provide any service, and nothing on the Site constitutes legal, financial, tax, or other professional advice. If you want to engage us for services, that happens through a separate written agreement, not by browsing this Site.
3. Contact Form and Newsletter
If you submit information through our contact form or sign up for our newsletter, you're giving us permission to use that information to respond to you and, if you opted in, to send you periodic emails. You can unsubscribe from the newsletter at any time using the link in any email we send. Our collection and use of this information is described in our Privacy Policy - please review it.
We don't sell the information you submit to us, and we won't add you to a marketing list unless you've affirmatively opted in.
4. Testimonials and Client References
Testimonials, quotes, or client references displayed on the Site are selected and curated by TMGS and reflect the experiences of specific individuals or organizations; they're not representative guarantees of results for any other client or engagement. We only display testimonials with the permission of the person or organization quoted, and we'll remove or correct one promptly if you tell us it's inaccurate or you'd like it taken down.
5. Intellectual Property
All content on the Site - including text, graphics, logos, design elements, and the TMGS name and branding - is owned by TMGS or used with permission, and is protected by copyright, trademark, and other applicable laws. You may view and share Site content for personal, non-commercial reference, but you may not copy, reproduce, republish, or create derivative works from Site content for commercial purposes without our written permission.
6. Acceptable Use
You agree not to:
Use the Site in any way that violates applicable law;
Attempt to gain unauthorized access to the Site, its systems, or any connected accounts;

To the maximum extent permitted by law, TMGS and its members, managers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Site - even if we've been advised of the possibility of such damages. Our total liability for any claim arising from your use of the Site will not exceed $100.
(This cap applies to Site use only. Liability related to paid services is addressed separately in your Service Agreement.)
10. Indemnification
You agree to indemnify and hold TMGS harmless from any claims, damages, or expenses arising from your misuse of the Site or your violation of these Terms.
11. Governing Law and Venue
These Terms are governed by the laws of the State of Louisiana, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Orleans Parish, Louisiana, and you consent to personal jurisdiction and venue there.
12. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted here with a revised "Last Updated" date. Continued use of the Site after changes take effect means you accept the updated Terms.
13. Severability
If any part of these Terms is found unenforceable, the remaining provisions will stay in effect.
